The judge's decision was wrong and overturned. More to the point, from the Eight I'd Really Rather You Didn'ts:

I don't even see how that would fly with the Koran, as the passages quoted simply say that a wife should sleep with her husband when he wants to. Doesn't say anything about "oh, and he gets to rape her if she doesn't."

The judge in the original case should get disbarred for sure, though.
