Is "The Flying Spaghetti Monster" trademarked?

If it isen't somebody needs to jump right on that before some religious group does and they'll own all rights to it. :paranoid:

I don't think you can trademark the name of a religion (although I suspect the church of scientology would if they could!!!).

For a company to trademark something, they'd have to first use it in relation to a distinctive commercial property or product. However as Bobby H first revealed the existence of the FSM and wrote about Him first, he'd presumably own the intellectual rights to the name and could hence require the company/ organistation to stop using it.

Trademarks and copyrights don't really work that way.

If you create something, it is automatically copyrighted to you, but it's up to you to prove you created it first.

Since the FSM is so famous and, as mentioned, the book was written, there shouldn't be a problem.

A trademark is used for companies selling goods or services. A religion is a belief, so dosen't need to register a trademark.

Images of anything aren't trademarked for any purpose unless they are logos anyway, copyright is the only thing used if that's not the case, whether it's for a religion or not.
Humpty dumpty sat on the wall, humpty dumpty had a great fall... The structure of the wall was incorrect so he won ten grand with Claims Direct!
