hatemail copyright issues

Published October 5th, 2007 by Bobby Henderson

I received this today. I decided to assume an email about hatemail copyright issues implies consent for posting here.

Dear Sir

I am not a writing to you to join your long list of “hate mail” attached to your wall I’m just offering some advise in which i suffer knowledge of in which have been expressed by the website (Including the address of http://www.venganza.org/). Though i do no have any formal expertise this is a area i have studied in the past and would like to bring to your attention.

Creative works are covered under international treaty as copyright which includes but is not exclusive to Email messages, handwritten notes, books, computer programs and web pages are all creative works and they are all protected by copyright. Put basically anything that is intellectual material other then your own DOES NOT belong to you. And therefore can not be copied without expressed permission.

In some circumstances sending an email creates an implied license for personal uses. Thought is would be extremely hard to prove in cases where copyright is attached. Also the uses or publication of names, email address and any other personal information without permission and protection is controled by The Data Protection Act (US:1998,2000 UK:1998,1986). And in this case would leave the publisher and affiliates liable to prosecution.

I do not wish to refefer to any specific violoation but i hope this information is of some use to you. Thank you for your time.

Yours Faithfully
James

Another note, people sending the hate-mail should have noticed by now that there is a section on this site dedicated to unsolicited hate-mail. Since they should know about it, they would not send something they would not want published here. They are sending it to Bobby, who owns a website of the subject being attacked, so it is relevant and he is perfectly free to publish HIS mail on HIS website. Since the letters are about this website, that makes them relevant to the subject and they will get published. He gives credit but not any sensitive info, therefore knowingly sending the mails indeed entitles him to publish them. If the sender did not fill out a form, nor pay for a copyright, any claims of infringement can be considered defamation.
Also, anyone using “gay” as a derogatory term can suffer penalty as slander and hate. Calling us “gay” slanders us and expresses hate for homosexuals. The Church of the FSM accepts people of all sexuality, see #4 in the 8 recommendations (I really rather you didn’t).

@ Wench Cyka, hello are you a Pagan? that’s great! sorry to hear you live in a hick town, try moving to New Orleans, where Vampires walk around the French Quarter right in front of the cathedral and don’t get hassled, because in the Crescent City, the Occult rules.
Also ‘Christ’ is not his name, it is the Greek word for ‘Messiah’, both meaning “anointed One in English.

How do you suffer knowledge? I find that the most hilarious part of the letter.

I am in no way claiming to be an expert on copyright law, but if it applies to all ‘creative works’ and intellectual property and that reproducing said work without permission is a violation of this law, where does that leave all these people trying to save us heathens by quoting the Bible in every second line? Wouldn’t the Bible come under this heading?
