Bryan Killian, a high school student in North Buncombe, North Carolina was suspended for coming to school dressed as a pirate.
But the disciplinary action has provoked controversy – because the student says that the ban violates his rights, as the pirate costume is part of his religion.

This story is blowing up and I’ve been having a lot of problems keeping the server running. It’s currently #1 on Digg and Reddit.

I personally know the kid, he’s friends with my buddies younger brother and I’ve seen him many o’ times. Everytime I’ve seen him, he’s not once had the eye patch on. This is ridiculous and I agree with the school 100%, he could have easily taken the eyepatch off and avoided geting suspended. The school is a place for learning, not trying to convert people to pastafarianism. He’s allowed to do this downtown in Asheville, even downtown in Weaverville, anywhere in public really. Do it those places, not in a high school.

We had a guy in school wear one after what I can only assume was an operation (actually he never said why he was wearing it), and he never got in trouble.

Poor kid. I wonder how an eye patch is disruptive to class I mean honestly we do and wear crazier things and dont get in trouble. the fsm has a growing presence at my school, we observe talk like a pirate day, every so often someone shows up wearing something piratish, and at least one person(myself) has the car emblem. My school also has problems with religious tolerance at times because we have a Jesus Club that is advocated by a teacher or two and the school is not supposed to advocate religion of any sort but the club fought and won the rigth to be on campus (duh) which helped the rest of us.

We need to write a letter and ALL sign it saying that it is blatant religious discrimination and we genuinely believe that it is more likely that the world was created by a flying spaghetti monster in 2 seconds and wants us to dress as pirates than Jesus died on the cross for our sins and assuming Bryan Killian believes the same they must respect his beliefs, religion and expression of it.

If he wants to express his is religous belief in the way he dresses then (within reason) the school should accomodate him assuming they don’t ban all other religious insignia/garb. If they find an eye patch unacceptable for safety reasons how about a tricorn hat? Or Skull and Cross-bones Bandana?
A wooden leg doesn’t sound very wise and a parrot probably isn’t hygienic.

@ everyone – this is such a good example of what is happening in this country. It’s shocking how the religious nutjobs are taking control (or at least trying to). I have thought for some time that it would be much better to ban all religious symbols from schools (no offense to His Noodlyness, but this is the best way to be fair, given that people are so completely idiotic). I think a school in Florida actually did ban all religious holidays in an attempt at a reasonable policy but had to reverse the decision because people are stupid.
My husband has said for some time that he likes it when people wear a crucifix or star of david – that way we know for sure the level of stupidity we’ll be dealing with when talking to those people!

To PP: I am from Europe and I live in the US for a few years, so I can tell you: it really is worse than I expected! Don’t get me wrong, there are some good things and some people really do think, but there isn’t much freedom or democracy here. If you would live in another civilized country for a while, you would understand. Your president is always preaching democracy and is acting like the dictator of the world. The USA doesn’t approve the world justice court (democracy??) and the USA and Somalia are the only countries in the world where they can have death penalty on children. And you can cry out Nazi-paroles, but you are not allowed to criticize the country (either love it or leave it! Hello, freedom??). I don’t want to be rude, I am a guest here, but you should start looking beyond your borders to change things, you can’t just lean back and stuck to your old ‘it used to be meant…’ structure. Things are changing to the worse and you have to act now. And just the two options to vote… c’mon!!

From everything I’ve read so far, it is just a public school here in the states.
It probably has a minor dress code i.e. Girls, no six-inch heels, no mini skirts above the waist, and yes, I hate to say this… Girls no Spaghetti strap halter-tops.
Boys; no bandanna’s or hats, or stupid baggy pants showing your ass crack, no gang colors.
Those are just basic that I can think of. Each school has a right, to implement their own dress code, this is done by the school board of said school (which is comprised mostly of parents) voting on how their kids should dress.

Again, from what I’ve read so far, this school had a basic dress code.
This kid wore an eye patch, to say that he could.
He did this to say, if you can wear a cross on your neck to show your faith,
I can wear a patch on my eye to show mine.
In my kid’s school, this would be acceptable.
The teachers would laugh about the one eyed handicap.

As far as the muslims and their full niqab, etc. etc.
If they have a large enough public school system in their neighborhood they certainly have a right to vote such dress in. This is a touchy subject since 9/11, understandable.
It’s not illegal for them to be in public dressed like this (although depending where they were, they could be mobbed).
Again, in my kid’s school, if you showed up in headgear, it would fall under the no headgear rule.

Think I might be late to this discussion, but as far as I know, in terms of religious gear in school, it’s for the most part allowed. You can wear crosses or stars of david (used to have one but it got lost somewhere along the way…still not sure where *shrug*) and a friend of mine wears her headscarf, despite the typical no-headgear ban; also seen a kid–don’t know him personally–wearing his kepa (Jewish version of the head-covering) around. I think exceptions are made on that ban for religious purposes; my friend’s allowed to keep it on for gym rather then change out of it and all that.
The only things not allowed religion-wise are those that cover up your entire body, like those…what are they called…tent-thingys Muslim women sometimes wear. (Not trying to be offensive, but they do look a bit like tents if you think about it.) And obviously if it has the potential to hurt someone else in the process…don’t think a Sheik could bring in his swords!

All in all, for my school it seems like if it’s your religion and you can show that you really do follow it, not just trying to be annoying and get away with coming in naked or something (^_^) they’ll work with you.

And to a few questions asked earlier, the dress code is clearly defined in our handbook, and it specifically says nothing about, eye coverings, or face coverings, just head coverings, like hats and toboggans ect. ect.
If you check this news story I just finished up with a cool guy named Jason Bugg, he came to my school and talked to the principal, and asst. principal (Sarah Cooley), and he personally said she wasn’t the best person, and was pretty rude. I´m Spanish, I apologize if this is not properly written:
I’ve three close relatives (my father among them) who work in public highschools. Now I feel curious and I’d like to ask them if there is or there is not any rules about clothing in public teaching institutions. I guess there isn’t, in Spain, any general regulation, and that it depends on teachers’ tolerance.
Once, my father asked one student to remove his cap. The student used it to hide earphones, which was known by all the teachers. I think it was the main reason for my father request.
I have worked as a teacher in private institutions, teaching students that needed extra-help to pass their exams. I’d only have problems with them if they wear:
- something that interferes with their learning (two eye patches… :-)
- something that makes hard to identify them (maybe some kinds of sunglasses, caps, hats… definitely a burka!!)
- something that clearly incites to violence (a t-shirt with a swastica)
- something clearly disrespectful towards me (a t-shirt with “our teacher is a b*tch” written on it)
I wouldn’t include a student dressed as a pirate, wearing one eye patch, in any of the above-mentioned categories.
I have to say that I wouldn’t like the exhibition of ostentatious religious or political symbols, as I think people come to my lessons to learn, not to display their believes, but it is a personal judgement and I wouldn’t make any remark to students wearing such symbols unless they involve what I’ve alreadyexplained.
And, after stating that I wouldn’t make any remark, I recognised that I would prefer a eye patch to an islamic veil, as the last one involves, to my mind, the thought that women’s hair incites to sin. Here in Spain, under the dictatorship of Franco, catholic religion (in its strongest interpretation) nearly considered the whole female body as something made by the evil. My grandma would have been thought to be a total sinner and indecent woman if she had gone to school wearing, for instance, trousers.
Since then, we have achieved an enormous freedom. I wore whatever I wanted during my highschool and university years. And I want to continue that way, so no step backwards!

I’ve had some closed-door discussions with captains of industry of the jewelry and faishon trade. They are quite extatic about the giraffe initiative. With people developing hugely long necks, they’ll need many, many more diamond necklaces etc to look chique. So designers and manufacturers of scarfs, necklaces are set for a huge boom once the giraffe initiative takes effect. And they’ve put their money where their mouth is. Our campaign fund is overflowing!

Whereas that country was once the cradle of European civilisation, it has obviously lost the embrace of His Noodly appendages. No surprise there, just look at the consumption of rice. While during the days of the ancient Greece there was not a grain of rice to be found in all of Greece, it is now commonly available in many ordinary restaurants in that country. It saddens me to see how deep that country has sunk. I think you’ll agree with me that firm action is required?

I and many of my friends believe it is far more likely that the world was created by a flying spaghetti monster – when a bit drunk or possibly hung-over – in around 2 seconds than by the Judao/ Christian God in six days.
Many eminent scientists around the world agree with us.
You might think what Bryan believes is stupid. A lot of ignorant people who don’t understand our beliefs do. I think your beliefs are stupid and nasty because of the way you treat Bryan. On the other hand Pastafarianism (which is what we call our religion) doesn’t hurt anyone, hate anyone or start wars.
It is spiteful and wrong of you to persecute people for their religion which you might remember from school was what your country was founded on. OK, so you guys have been drifting off that recently, but that’s no excuse. You have an opportunity to make America what it should be not what it is and welcome pupils wearing full pirate regalia and other piratical garments with open arms.

Although a bit off topic, I must point out that wearing an eyepatch served a valid function for pirates as they moved from on deck to below deck, as demonstrated by the Mythbusters. When walking into a dark school from the bright outside or from a bright classroom into a dim hallway, merely switching the patch from eye to eye allows the night vision eye to take over greatly improving vision in the dim light and not having to wait for adjustment. Perhaps the school’s energy efficiency lighting policy was to blame, and the poor fellow was just trying to see. Any eyepatch would be more functional that sunglasses under these conditions.

I stumbled upon His/Her (do you actually know which?) noodliness one night as I was searching through Google for the correct way to spell a certain conjugated form of the word “numbers” in Finnish. For those of you wondering: Yes, I am Finnish and in my language we conjugate all word classes with suffixes. I can only think that i witnessed an al-dente intervention by The Noodly One and was always meant to discover Him/Her.

Consequently I have attended school in Finland and will tell something about it. When I started in 1st grade in 1988, a normal school day started with a prayer. Around 1991 prayers in schools like the morning devotion were outlawed, I believe because we have freedom of religion and separation of state and church in Finland also. Already in 10th grade almost all students at my school and I believe at most other schools also would be irritated by the teacher of religion class when she, a priest by training, was biased in favour of protestant christianity. I and many others thought that being devoutly religious made her unfit to teach religion, as the purpose of the class is not to convert/reaffirm students.

My first day of school during high-school exchange in Australia was shocking, as every day at this private school started with a public prayer in assembly or through the intercom.

I remember reading about the Kansas school board decision a few years ago, and am very surprised to see the issue still alive today! I believe a story as silly as ID would not have survived more than a few days, if it were not a means of the FSM to finally reach the public eye and with the prophet begin a culinary concuest of the hears of all mankind.

And my sympathies to brave Brian Killian for the very unfair treatment he has received. May you be one with the FSM one day!

Yes, I have one bad eye and have no depth perception to speak of. I never had any problems concentrating on the blackboard, books etc. I have no problems driving either. I just had to learn what the distances are instead of just seeing them.

I happily and traditionally dress like a pirate every friday whether or not I am at school, and my high school has given me only minor harassment for it. My school passed a rule banning all hats from being worn inside (a common courtesy, no?) around the same time that I converted to Pastafarianism. The school did try and get me to remove my hat, but al long as I refused to remove it and shook my pocket Constitution at them they knew there was nothing they could legally do.
So I violate the dress code every Friday and the school can’t do anything. It sounds to me like this kid is doing the same thing, and should get the same treatment. I’m sorry now that the school did not suspend me, for then I couldhave brought a lawsuit and set a precedent for this case.
Continuing my missionary work here in the boondocks of Tucson….

As every school system in the world does. It’s part of becoming acceptable in a society. Somewhat necessary where ever you live. Like it or not.

I agree with Peter. In Australia the school system on occasion places to greater emphasis on free thought rather then “the basics” in some cases. Spelling and basic maths skills have suffered as a result. We do have to conform to rules designed to allow ourselves and others the best opportunity to learn i.e. I can wear my patch at lunch but I can really see the blackboard when I wear it in class, plus it does tend to be disruptive, I guess.

Wow – so the hindus, buddhists, taoists and muslims that condemned the attacks were also borrowing for christian ethics – which clearly is the only system of ethics on the planet. Ever since these wars by the Bush administration started, I have had this picture in my head of a devout christian going to his preast and asking: ‘Was he really serious about this “turning the other cheek” and “doing unto others as you would have done unto you” -part? And what about that “do not judge so that you yourself would not be judged”?’ Christians for military action and punishments for immoral behaviour are just strange ideas in my view.
